Need Advice

I bought a Chassis from 93-306 on 12-24-09, and got it in on 1-4-10 and found the bottom of the Chassis broken. He said he had insurance on the chassis, and received a letter to turn the Chassis in to the Post Office.

On 2-26-10. 93-306 said he got a letter in the mail yesterday saying they were not going to cover it.

Now I'm out a Thunder Tech Tremor Chassis, and the money I sent to him. He has a lot of positive feed back so I thought I wouldn't have any problems.

I asked him for a refund, or a different truck that he could send to me. He replied that he didn't have any money for a refund and that he sold all of his trucks. :-(

Paypal won't get involved due to being out of the 45 day dispute period.

Right now we are at a Stalemate . I'm wondering what would be a fair thing to do.

Post pics of the chassis, and if you have it the box, etc it was shipped in. It seems a little weird that he had insurance and they wont cover it, whats the point of having the insurance than?

I never took a picture of the box since it appeared to be in good condition and not smashed. The chassis was wrapped in bubble wrap and the surround by two bodies and news paper.
The crack on the chassis is on the bottom near the lower link.

That blows man. It almost seems like he tried to pull a fast one on you...

I would like to think he is an honest seller. He has a lot of positive feed back on this forum. All I know If I sold something that was broken, I would refund the money.

He's a good guy, I've dealt with him a couple of times and they were both smooth deals. With that said this is entirely on him. He was the one who packed the chassis and he is the only one that USPS will deal with regarding the claim so he has the responsibilty of making it right.

BTW where's the chassis now?

Not to sure. He said he needed to pick it up from the post office if he wanted the chassis back.

hmmm, honestly, even though you bought it second hand I'd try contacting Thundertech, they might be able to cut you up a new chassis plate. It sucks, but I think both of you need to look more into this insurance with USPS. Its not right that you or he paid for it and they arent doing anything. I dont think he can be blamed 100% if the truck was packed as well as you said it was. Also, did you keep any emails or pictures of what was shown before you sent money?

You would have to knock the crap out of the box to damage the chassis like that. If the box looked good, then the chassis was packed in that condition. Sounds like the USPS thinks this as well.

I hate to chime in here but I am not gonna get bashed either. I pay extra on every truck I sell just for this reason. I DO NOT SELL JUNK and I think my feedback on here reflects this. I pack every thing I sell the best I can to try to prevent this sort of thing. I know it was not damaged when it left my hands and here again I think my feedback can prove this. I have all but gotten out of this hobby nor do I have the cash to refund him the money for a broken chassis that WAS NOT broken when it left me. Now what the USPS does is out of my control all I can do is show my butt and try to make something happen. I have however offered to pay for a replacment side to replace the broken one if we can get in contact with TTR. I am not going to get in a match here trying to bash each other just want to state some of the other facts of the matter. So with this said I am gonna get in touch with the PO today to see what we can do.:bang

I won't be surprised if you have to argue with them to get them to pay up a claim. I think they deny every one right off the bat just to try and save money. UPS tried to deny my sisters claim 2 or 3 times when they smashed her computer. Finally they said that it obviously wasn't packed well enough, so it wasn't their fault. Then she showed them the receipt where she had it PACKED and shipped by the UPS store. LOL They finally paid up. It took a few weeks of this back and forth crap though.

Lets let the actual parties involved here solve this, should have some sort of answers in 48 hours as to the PO answer, if not he stated he'd pay for a new plate(s).

So lets wait this out for now and not get a couple armies together and pretend it's Iraq. :wnk Nobody wins a war.

Well I just got off the phone with the PO and they are gonna send you a copy of the denial letter. The chassis is at your PO in Hi so I can't pick it up you will have to do so. I have called TTR repeatly with no answer and have emailed them with the same responce. I also called Xtreme Racing to see about cutting a set of sides and it is a Min 1 hour at $50 on CAD and a Min 1 hour at $50 on set-up plus materials and they will need one of the sides to use, so their is no telling what the end result would be as far as cost and times goes. All I can do is hope TTR will return my calls or I can catch them on the phone.

Why this is here I have no clue but I am gonna continue to post info here about the issue utill it is resolved or I am told not to do so.

This is just an FYI.

Here is two different companies that do strictly carbon fiber work and at least the first one is hobby based. Hopefully one of them can help you out if TTR proves to be unsuccessful.

My opinion may not count for much but here it is anyways. We all know that when we buy something second hand in this hobby that it comes "as is" with no kinda warranty and we depend on feedback from all of our fellow hobby people to help us make our decisions. Judging by 93-306 feedback I don't feel as if it was anything he was aware of. Had he known, I feel sure, he would have made note of it in any descriptions posted. I think USPS needs to cover the package since insurance was taken out. Just my $.02

Update!! Got in touch with TTR and they are gonna cut me as many plates as needed and I am gonna foot the bill for either 1 or 2. Well in the meantime Mugen69 has done a chargeback with his credit card co saying the item was not as described witch is false. So now I have no chassis, Paypal is locked out with a neg. balance and he will not respond to my PM's. I just thought everyone on here should know this to know what everyone is dealing with. I have a ton of feedback from prominent members on RCMT with no complaints so far but now I do so just have to take it a day at a time and build my rep b ack up. Ohh well live and learn.

Well sir I am sorry to hear that this isn't over yet. I find it odd that the other party doesn't respond to pm's or emails. If the post office can not find the package and he isn't responding maybe just maybe u got scammed. Cause if he has the chassis and has been re-imburssed by his credit card company causing you a negative balance in paypal he has it for free leaving u empty handed I would contact the fraud center either paypal or even FBI to investigate it. If the post office can't find it then they need to refund you your money lost and enough for a new chassis. But once again this is just my $0.02. You don't have to worry about proveing urself to anyone u dealt with in the past and most people expect there to be an ocassional pain in the butt in the crowd. Keep your head up it will all work out in the end.
